1. Eligibility: The Coca‑Cola Holiday Happy Hour Instant Win Game (the “Promotion”) is open only to legal residents of 50 U.S. and DC (“eligibility area”), who possess a web-enabled mobile device, and are 13 years of age or older as of date of Game Play (“Entrant”). App download is required. If participant is a minor, they should consult with their parent or legal guardian for any additional restrictions required for usage. Void outside the eligibility area and where prohibited by law. Employees of The Coca‑Cola Company (the “Sponsor”), Coca‑Cola bottlers, Don Jagoda Associates, Inc. (“Administrator”), and their respective subsidiaries, parent, divisions, franchisees, promotional partners, agencies, affiliates, advertising and promotion agencies (collectively, the “Released Promotion Parties”) as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee, are not eligible to participate or win/receive an offer. This Promotion is subject to all applicable federal, state, and local laws and regulations. Participation constitutes Entrant’s full and unconditional agreement to these Official Rules. If you are a minor, you must have your parent or legal guardian agree to be bound by these Official Rules and all provisions included in the Official Rules.

 

2. Promotion Period: The Promotion begins at 2:00 pm Eastern Time (“ET”) on December 4, 2023 and ends at 1:59 pm ET on January 15, 2024 (“Promotion Period”). The Promotion Period will consist of six (6) weekly play periods (each a “Play Period”) as described in the chart below. Each Play Period will start at 2:00 pm ET on the first day of Play Period, and will end at 1:59 pm ET on the end date listed.

3. How to Play: There is NO PURCHASE NECESSARY to participate. A purchase does not increase your chances of winning/receiving an offer.

During the Promotion Period, if you have or wish to download the +one app for free, you can log in or create your +one Account (“Account”) and follow the instructions to log in or create an Account. If you do not have the app, to create one for free, download the free +one app to your web-enable mobile device at either the Apple® App Store or the Google® Play store. Once logged in, you will be prompted to participate (“Game Play”) to see if you’ve received a prize/offer. All on-screen wins/notifications are subject to verification. All Game Plays become the property of Sponsor. Receipt of Game Plays may be acknowledged, but such acknowledgment does not constitute any representation as to eligibility. Limit one (1) Game Play per person per Play Period. Any attempt by any Entrant to obtain more than the stated number of Game Plays by using multiple/different email addresses, identities, registrations or logins, or any other methods will void that Entrant’s Game Plays and that Entrant may be disqualified from the Promotion. Any use of robotic, repetitive, automatic, programmed or similar registration/Game Play methods or agents (including, but not limited to, Promotion Game Play services) will void all Game Plays by that Entrant. In the event of a dispute as to any Game Play, the authorized account holder of the email address used to register will be deemed to be the Entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential prize winners may be required to show proof of being the authorized account holders.

 

4. Verification/Winner Notification/Prize/Offer Fulfillment: All winners/offer recipients are subject to confirmation, verification of eligibility by Administrator and compliance with these Official Rules in Sponsor’s sole discretion. All material submitted becomes the sole property of the Sponsor and will not be returned. If, due to an error of any kind, more instant winning/offer messages are delivered to Entrants, or more prizes/offers are claimed than are intended to be awarded per Rule 5, the intended number of prizes/offers will be awarded in a random drawing from among all verified prize/offer claims received during that Play Period. The Sponsor and its agencies assume no responsibility for any injury or damage to Entrant’s or to any other person’s computer relating to or resulting from entering or downloading materials or software in connection with the Promotion. No responsibility or liability is assumed for damages, losses or injury resulting from acceptance or use of any prize/offer.

 

All prizes/prize codes with the exception of the National Parks & Federal Recreational Land Annual Passes and Shutterfly Photobook offer will be fulfilled to the email address associated with your +one Account within 2-3 weeks after verification. Return of any prize/offer code as undeliverable will result in disqualification and prize/offer will be forfeited.

 

National Park Annual Pass prize winners will be emailed a link where they will be required to provide their full mailing address for prize fulfillment purposes and must respond within three (3) days or prize will be forfeited. After winner verification, prizes will be shipped to address provided in January of 2024. Once it is confirmed that the prize has been delivered to the winner’s provided address, the Sponsor is no longer responsible for the security of the prize and will be unable to replace the prize in the event it is stolen/damaged. Unclaimed prizes will not be awarded.

 

Shutterfly Photobook offers will be awarded via a digital code within the +one app.

6. General Rules: By participating in the Promotion, Entrant (or if a minor, parent/legal guardian) fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor and Administrator, whose decisions are final and binding in all matters related to the Promotion. By participation in the Promotion, Entrants (or if a minor, parent/legal guardian) and prize winners release and hold harmless the Released Promotion Parties from and against any and all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with submitting a Game Play or otherwise participating in any aspect of the Promotion, the receipt, ownership or use of any prize/offer awarded, or while preparing for, participating in any prize/offer-related activity or any typographical or other error in these Official Rules or the announcement or offering of any prize/offer.

 

7. Disputes: Entrant (or if a minor, parent/legal guardian) agrees that: (a) he/she releases and will defend, indemnify and hold harmless the Released Promotion Parties from and all any and all claims; (b) claims arising out of or connected with this Promotion, or any prize awarded shall be resolved individually, without resort to any form of class action, and solely and exclusively in a federal or state court located in Atlanta, GA; (c) Entrant submits to sole and exclusive personal jurisdiction to said courts in the State of Georgia for any such dispute and irrevocably waives any and all rights to object to such jurisdiction; (d) any and all claims, judgments, and awards shall be limited to actual damages of no more than $100, including costs associated with entering this Promotion, but in no event attorneys' fees; and (e) under no circumstances will Entrant be permitted to obtain awards for and Entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Entrants or the Released Promotion Parties in connection with this Promotion shall be governed by, and construed in accordance with, the laws of the State of Georgia, without giving effect to any choice of law or conflict of law rules of provisions (whether of the State of Georgia, the United States, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Georgia.

 

8. Privacy Policy: Information collected by Sponsor in connection with this Promotion may be used by Sponsor and shared with third parties involved in administration of the Promotion in accordance with the Sponsor’s online Privacy Policy posted at https://www.coca-cola.com/us/en/legal/privacy-policy. The Entrant (or if a minor, parent/legal guardian) agrees to the collection, processing and storage of his/her personal data by Sponsor for the purposes of the Promotion.
